Terms of Service
1. Who we are
BookBurial operates in England and Wales (the "Company", "we", "our", "us"). These terms form a legally binding agreement between you (the "Customer") and the Company.
Contact: book.burial@webmatter.co.uk.
2. The service
The Company provides a postal burial service for paper-based religious literature in the United Kingdom. On receipt of payment and your parcel, we store the contents respectfully and bury them at a partnered UK Muslim cemetery during a pooled burial event, typically within six (6) months of receipt.
3. What we accept
We accept paper-based religious literature only. This includes:
- Printed or handwritten Qurans, complete or partial
- Hadith collections, tafsir, du'a and prayer books and booklets
- Islamic schoolbooks, madrasa workbooks, and educational Islamic texts
- Loose paper pages bearing Arabic verses, the name of Allah, or the name of the Messenger ﷺ
- Paper-based greeting cards, posters, and laminated timetables bearing Qur'anic content
4. What we do not accept
We do not accept, and will not bury, any of the following:
- CDs, DVDs, cassettes, USB sticks, external drives, or any form of digital or electronic media
- Tasbih beads, prayer mats, prayer caps, clothing, or textiles
- Ornaments, figurines, statues, tapestries, or wall art
- Children's toys of any kind
- Items containing batteries, circuit boards, speakers, or electronics
- Items primarily made of glass, metal, plastic, or ceramic
- Framed artwork, heavy hardware, or anything with a non-paper primary material
- Hazardous materials of any kind
If you send items we do not accept, we reserve the right to return them to you at your cost, hold them pending instruction, or (if you've provided written consent in writing) dispose of them ordinarily. We are not liable for the condition or handling of non-accepted items.
5. Pricing and payment
- Prices are shown in GBP on our website and include VAT where applicable.
- Payment is taken at the point of order via Stripe.
- We may change prices at any time. Changes do not affect orders already placed and paid for.
- The price you pay covers handling, storage, burial, and plot donation. It does not cover postage to us.
6. Shipping — customer's responsibility
- The Customer is responsible for shipping the parcel to our receiving address at their own cost.
- We recommend Royal Mail Tracked 48 or equivalent traceable service. We are not liable for parcels lost, damaged, or delayed in transit. Claims for lost parcels must be made by the Customer directly against the carrier.
- Risk in the parcel passes to us only when we physically sign for and confirm receipt.
- Please include the reference number we email you on a slip inside the parcel. Without it, we cannot match your parcel to your order, which may delay processing.
7. Timing
- We aim to acknowledge receipt of parcels within five (5) working days of arrival.
- Pooled burials are conducted on a schedule that depends on volume — typically twice per calendar year. We do not guarantee a specific burial date.
- Delays caused by matters outside our reasonable control (weather, cemetery availability, public holidays) do not constitute breach of these terms.
8. How your items are handled
- Parcels are opened only for cataloguing, sorting, and shrouding. They are stored off the floor in a dedicated, clean facility prior to burial.
- Items are never photographed for display, sold, or transferred to third parties.
- At burial, items are interred in a clean, private plot at a partnered Muslim cemetery where members of the public do not walk.
9. Consumer cancellation rights
Because we provide a service that begins on physical receipt of your parcel, your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 applies as follows:
- You may cancel for any reason before your parcel arrives at our facility, and receive a full refund minus any third-party transaction fees (typically £0.35–£0.50 per Stripe charge).
- By sending your parcel, you request that service performance begin. Once the parcel has arrived and been catalogued by us, the service has materially commenced and no refund is available.
- See our full Refund Policy.
10. Our right to refuse service
We reserve the right to refuse, suspend, or terminate service in cases of:
- Repeated submission of non-accepted items
- Fraudulent orders or payment chargebacks
- Abusive conduct towards our staff
- Any use of the service that breaches applicable UK law
11. Liability
- Our total aggregate liability to you in connection with any order is limited to the price paid for that order.
- We are not liable for indirect or consequential loss, loss of profit, or loss of goodwill.
- Nothing in these terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.
- For the avoidance of doubt, religious or sentimental value of items buried is not quantifiable damages under these terms.
12. Data protection
How we handle your personal data is governed by our Privacy Policy.
13. Variations
We may update these terms from time to time. The version in force at the time you place an order is the one that applies to that order.
14. Governing law and jurisdiction
These terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Severability
If any provision of these terms is found to be unenforceable, the remainder shall continue in full force and effect.
